HOW TO DISSOLVE A MARRIAGE WITH A FOREIGNER IN RUSSIA?
You can dissolve a marriage with a foreigner through a Russian registry office (ZAGS) if:
- You are a Russian citizen and are located in Russia;
- The marriage was registered in Russia;
- You have no common minor children;
- The foreign spouse is in Russia;
- Both spouses agree to the divorce.
Next, both of you should go to any ZAGS and submit a divorce application. After one month, the marriage will be dissolved, and ZAGS will issue a certificate and place a stamp in your passport.
Is the foreign spouse or you not in Russia?
In this case, either of you can issue a power of attorney through the Consulate or a notary to a lawyer or another trusted person who will sign the divorce application on your behalf and collect the certificate.
If the foreign spouse avoids signing the application personally or through a representative, you have the right to file a divorce petition with a Russian court. Generally, it is quicker to obtain a divorce through a Russian court, as the reasons for the divorce and whether the spouses owe each other compensation, etc., are not considered.
